Energy Community welcomes the Constitutional Court’s judgment on the ANRE case

I am addressing you in relation to the decision the Constitutional Court of Moldova adopted on 8 December 2015, ruling unconstitutional the Parliament’s decision to dismiss the Board of Directors of the Energy Regulator of Moldova (ANRE). As you know, Energy Community law requires all Contracting Parties, including the Republic of Moldova, to ensure independence of the energy regulator. Its competences and independence are of utmost importance for the fair, transparent and efficient performance of the energy sectors in the country. The independence of ANRE has been impaired several times already for purely political reasons. Against this background, we highly welcome the very important decision of your esteemed institution. It has proven that the Constitutional Court is not only a guardian of the constitutionality of Moldovan law, but also of Energy Community law and the rule of law in general in the Republic of Moldova. I would like to thank you personally for that.
