A Direct Dialogue: Constitutional Court of Moldova – Court of Justice of the European Union
The date of 23rd of February marks the 22nd anniversary of the Constitutional Court of Moldova (CCM) and on this occasion it held a videoconference with the Judge of the Court of Justice of the European Union (CJEU), Egidijus Jarašiūnas, on the "Relations of constitutional courts with the CJEU. The influence of the jurisprudence of CJEU on the development of constitutional doctrine."
The President of CCM, Alexandru Tănase, mentioned in the opening message that the event marks the 22nd anniversary since CCM has been established in 1995, and that the topic of the conference will help in becoming acquainted with European law, in particular given Moldova is implementing the Association Agreement with the EU. In this context, Alexandru Tănase mentioned that CCM in its rulings is inspired by practices and principles of CJEU, particularly on free competition.
In his speech, Egidijus Jarašiūnas presented the role and caselaw of CJEU, as well as the cooperation between Constitutional Courts and CJEU.
Elaborating on the contribution a Constitutional Court may have in preparing a State to join the European Union, Mr Jarašiūnas mentioned that the support of lawyers' teams is needed, including of constitutional judges, in preparing the legislative framework for the accession. Thereby would be avoided divergences between domestic and EU legal order.
Further, discussions within the conference were focused on the impact the caselaw of the CJEU has on the constitutional doctrine.
The event was attended by current and former judges of CCM, representatives of the Government, Union of Lawyers, civil society and academia. The conference was broadcasted live and the viewers were given the opportunity to address questions in real time.
The event was carried out by CCM in cooperation with the EU Project "Support for the Constitutional Court of Moldova."
Prof. Egidijus Jarasiunas is a Judge of the Court of Justice of the European Union, who in the past was an MP of Lithuania, judge of the Constitutional Court of Lithuania and is a signatory of the Act of 11 March 1990 re-establishing Lithuania's independence. Egidijus Jarasiunas was also a member of the Venice Commission in 2006-2010.
